Terms of Service

These Terms of Service ("Terms") govern your use of the Know Before You Vote application and website at knowbeforeyouvote.com (the "Service"), operated by Know Before You Vote ("we," "us," or "our"). By using the Service, you agree to these Terms.

1. Nonpartisan Disclaimer

Know Before You Vote is a nonpartisan voter education tool. The information provided through the Service is for educational and informational purposes only and does not constitute an endorsement of any candidate, political party, ballot measure, or political position. We do not advocate for or against any candidate or issue. Users should form their own opinions based on their own research and values.

2. Accuracy Disclaimer

Election information displayed in the Service is sourced from publicly available records, official government databases, and other public sources. While we strive for accuracy, we cannot guarantee that all information is complete, current, or error-free. Candidate information, polling locations, ballot details, and other election data may change without notice.

Always verify election information with your local election authority or official government sources before making voting decisions.

3. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service. We may update these Terms from time to time; continued use after changes constitutes acceptance of the updated Terms.

4. Use of Service

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Service to spread misinformation about elections, candidates, or voting
  • Impersonate another person or misrepresent your affiliation
  • Interfere with or disrupt the Service or its infrastructure
  • Attempt to gain unauthorized access to any part of the Service
  • Use automated means to scrape or extract data from the Service
  • Use the Service in violation of any applicable local, state, national, or international law

5. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate information when creating an account. You agree to notify us immediately of any unauthorized use of your account.

6. User-Generated Content

Survey responses and other content you submit through the Service ("User Content") remain yours. By submitting User Content, you grant us a non-exclusive, royalty-free license to use it to provide the Service (for example, generating your candidate match results). We do not share your individual survey responses publicly.

7. Account Termination

We reserve the right to suspend or terminate your account at our discretion if you violate these Terms or engage in conduct that we determine is harmful to other users or the Service. You may delete your account at any time by contacting us at contact@knowbeforeyouvote.com. Upon termination, your right to use the Service ceases and we may delete your data in accordance with our Privacy Policy.

8. Intellectual Property

The Service and its original content, features, and functionality (excluding User Content) are and will remain the exclusive property of Know Before You Vote and its licensors. Election data sourced from public records remains in the public domain.

9. Third-Party Links

The Service may contain links to third-party websites, including official voter registration portals, election authority websites, and other external resources. We are not responsible for the content, accuracy, or practices of any third-party sites. Accessing third-party links is at your own risk.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure. We do not warrant the accuracy or completeness of any election information provided through the Service.

11. Limitation of Liability

To the fullest extent permitted by law, Know Before You Vote and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or related to your use of the Service, whether based on warranty, contract, tort, or any other legal theory, even if we have been advised of the possibility of such damages.

In no event shall our total liability exceed the amount you paid us in the twelve (12) months prior to the claim, or $100, whichever is less.

12. Indemnification

You agree to indemnify and hold harmless Know Before You Vote and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service or violation of these Terms.

13. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in North Carolina, and you consent to the personal jurisdiction of such courts.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms within the app and updating the effective date. Your continued use of the Service after changes constitutes acceptance of the new Terms.
